This Policy applies to every visitor to our website, every individual who creates an account, and every person or entity that places an order, and it is incorporated by reference into our Terms & Conditions.
1. Scope
This Policy applies without exception to every product listed in our catalog, to every visitor browsing our website, to every individual or organization that registers an account, and to every purchaser who places an order, regardless of order size, purchase frequency, or destination. By accessing our website or placing an order, you agree to be bound by this Policy in full.
2. Intended Use
All products sold by Lumera Labs are manufactured, packaged, and sold strictly for in-vitro laboratory research. They are intended exclusively for use by qualified professionals — including trained laboratory personnel, credentialed researchers, and research institutions — operating within controlled research environments equipped for the safe handling of research chemicals. No product offered by Lumera Labs is intended for any use outside of this controlled research context.
3. Prohibited Uses
The following uses of any Lumera Labs product are strictly prohibited under all circumstances:
- Human use of any kind, including but not limited to ingestion, injection, topical application, inhalation, or administration by any other route
- Animal use of any kind, including veterinary application or administration to any living organism outside of a controlled in-vitro research setting
- Therapeutic, diagnostic, or medical use, including any application intended to treat, diagnose, cure, mitigate, or prevent disease in humans or animals
- Compounding, formulating, or incorporating any product into a drug, pharmaceutical preparation, or medical device
- Use in, or incorporation into, dietary supplements, foods, beverages, or cosmetics
- Resale, redistribution, or transfer of any product for a use prohibited under this Policy, or to any party the seller knows or reasonably suspects intends a prohibited use
Engaging in, facilitating, or attempting any of the foregoing constitutes a material breach of this Policy and of the Terms & Conditions governing your use of our website and products.
4. Regulatory Status
Products sold by Lumera Labs are not drugs, are not dietary supplements, and are not approved, cleared, or otherwise evaluated by the U.S. Food and Drug Administration (FDA) or any comparable regulatory authority for any therapeutic, diagnostic, or medical purpose. No representation is made, and none should be inferred, regarding the safety, efficacy, or suitability of any product for use in or on humans or animals. All products are labeled “For Research Use Only. Not for Human or Animal Use,” consistent with the labeling standard set forth in 21 CFR § 809.10(c)(2)(i), and this labeling must not be altered, obscured, or removed by any purchaser.
5. Buyer Attestations
Before creating an account and before completing any purchase, each purchaser must affirmatively attest to each of the following, and each attestation is reaffirmed at the point of checkout for every order placed:
- I am at least 21 years of age
- I am a qualified researcher or research professional, or I am purchasing on behalf of a qualified research institution or laboratory
- I am authorized to purchase, receive, and handle research materials of this nature
- I will use all purchased products exclusively for lawful in-vitro laboratory research and for no other purpose
- I have read, understood, and accept the Terms & Conditions governing purchases from Lumera Labs
A false attestation under this section is grounds for immediate order cancellation and account termination under Section 9 of this Policy, in addition to any other remedies available to Lumera Labs at law or in equity.
6. Product Standards
Lumera Labs sources exclusively analytically verified materials through a batch-controlled supply chain. Each production batch is subject to third-party analytical testing, including high-performance liquid chromatography (HPLC) and mass spectrometry, to confirm identity and purity. A certificate of analysis (COA) corresponding to each batch is available upon request to support the research and documentation needs of our customers.
7. No Dosing, Preparation, or Administration Guidance
Lumera Labs does not provide, and will not respond to inquiries requesting, guidance on dosing, reconstitution or preparation for administration, method or route of administration, or storage intended to support administration to a human or animal. Any such inquiry directed to our staff will be declined as inconsistent with the research-only purpose of our products. Customers seeking guidance on the safe handling and storage of research materials in a laboratory setting should consult the applicable safety data sheet and their institution’s laboratory safety protocols.
8. Purchaser Responsibility and Liability
The purchaser assumes sole and complete responsibility for the compliant procurement, storage, handling, and use of any product purchased from Lumera Labs, and for ensuring that such procurement, storage, handling, and use comply with all applicable federal, state, and local laws and regulations. By registering an account or completing a purchase, the purchaser acknowledges and agrees to this Policy in its entirety and agrees to defend, indemnify, and hold harmless Lumera Labs, its owners, officers, employees, and affiliates from and against any and all claims, damages, liabilities, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to any use of a purchased product that is inconsistent with this Policy.
9. Enforcement
Lumera Labs reserves the right to screen orders and account activity for indications of use inconsistent with this Policy. Lumera Labs maintains a zero-tolerance posture toward suspected misuse. Where misuse is suspected, Lumera Labs may, in its sole discretion and without prior notice, cancel the order in question, refuse to provide further service to the individual or organization involved, and permanently terminate the associated account. These remedies are in addition to, and not in lieu of, any other rights or remedies available to Lumera Labs.
